China Hainan Province has recently put into effect the “Management Measures for the Carrying and Use of Clinically Urgent Imported Drugs and Medical Devices,” a set of regulations designed to ensure the safe and controlled use of medications and medical devices by patients after they are discharged from medical hospitals.

Under these new measures, only patients with a clear clinical diagnosis, stable treatment plan, good compliance, and controlled condition are eligible to carry prescribed medications and medical devices upon leaving the hospital. Medical institutions are responsible for assessing the necessity and safety of allowing patients to take these items home, and they must establish a detailed plan for home use, including emergency protocols.

The regulations stipulate that the quantity of medications allowed to be taken home should generally not exceed a four-week supply. However, for patients with stable conditions and mild drug side effects, this can be extended to a maximum of 12 weeks. For prescriptions exceeding four weeks, physicians are required to conduct a thorough assessment, provide patient training, and document the agreement in the patient’s medical record, which the patient must confirm with a signature.

The quantity of medical devices allowed to be taken home should meet the patient’s needs, with specifics determined by the medical institution based on the product instructions and the patient’s condition.

To ensure that the prescribed drugs and devices are used exclusively by the designated patients, medical institutions are instructed to destroy the original packaging of these items and mark the internal packaging and instructions with “For use by [Patient Name] only.” Alternatively, special packaging designated for home use may replace the original packaging, but must include product name, specifications, expiration date, storage conditions, and usage instructions.

Furthermore, medical institutions must link the patient and product information in the drug and device traceability management platform, ensuring that the smallest independent packaging or special home-use packaging is traceable throughout the entire process.

Patients are required to sign an informed consent form and a commitment letter, agreeing to use the prescribed drugs and devices strictly for personal use and not to resell or redistribute them. Prescribing physicians must monitor patients’ medication usage and report any irregularities, such as significantly shortened usage periods without reasonable justification, to the local medical regulatory authority. Similarly, physicians responsible for medical devices must keep track of patients’ usage and take appropriate actions in case of irregularities, reporting the outcomes to the regulatory authority.
